Case: 145 F. Supp. 2d 126 (D. Mass. 2001) and 329 F.3d. 43 (1st Cir. 2003)
Betty Ann Blake was a profoundly disabled adult woman who died as the result of medical malpractice at a Fall River hospital. The case was settled after two jury trials in federal court. The claims were a challenging blend of medical malpractice and discrimination by the Defendant hospital. The first trial resulted in a verdict for the Defendants, but was later reversed by the United States Circuit Court of Appeals.
